These Terms of Use apply to your use of AskGive.org, a generative AI program of BBB Wise Giving Alliance. These Terms form an agreement between you and BBB Wise Giving Alliance. By using AskGive.org, you agree to these Terms.

Please take the time to read and familiarize yourself with BBB Wise Giving Alliance’s Privacy Policy, as it explains how personal information is collected and used. Your use of AskGive.org is subject to the Privacy Policy.

Who We Are

BBB Wise Giving Alliance exists to strengthen public confidence in charities by promoting wise giving and trustworthy charity practices. AskGive.org, a conversational AI tool, readily answers questions about causes, charities and giving, and can provide advice on how to identify trusted charities. All answers are compiled from Give.org’s trusted knowledgebase. To encourage further exploration, AskGive.org includes links to relevant resources at the bottom of each answer including, but not limited to charity reports on give.org, Wise Giving Wednesday blog posts, Wise Giving Guide articles, the Heart of Giving podcasts, the Building Trust YouTube series, and BBB Wise Giving Alliance’s Donor Trust Reports.

Access and Use

You must be at least 18 years of age to use AskGive.org . If you agree to the Terms, you represent that you are at least 18 years of age.

Using AskGive.org

Your use of AskGive.org indicates that you agree to follow and be bound by these Terms. In using AskGive.org, you must comply with all applicable laws and any other applicable policies we make available to you.

You may NOT use AskGive.org for any unlawful or harmful purpose, or in furtherance of illegal activities. You may NOT:

• Attempt to interfere or disrupt AskGive.org.

• Represent that the answers from AskGive.org were human-generated when they were not.

• Use AskGive.org in a way that infringes, misappropriates or violates anyone’s rights.

• Attempt (nor allow a third party) to reverse engineer, decompile, disassemble or discover the source code or underlying structures, ideas or algorithms of AskGive.org.

• Copy, modify, distribute, sell, or lease AskGive.org.

Discontinuation of AskGive.org

We may choose to discontinue the AskGive.org product at any time.

Termination and Suspension

You may stop using AskGive.org at any time. We reserve the right to restrict your access to AskGive.org if we determine that you breached the Terms of Use, or if we are obligated by law.

If you believe that we have restricted your use to AskGive.org in error, please contact evazquezdamico@give.org.

Content

You may input questions into AskGive.org and receive answers from AskGive.org. You are responsible for the content of the questions that you provide. Your questions shall not violate any applicable laws.

You retain ownership rights in your questions and BBB Wise Giving Alliance retains ownership in the answers.

Due to the nature of AskGive.org and of generative AI, answers may not be unique and other users may receive similar or identical answers from AskGive.org.

Right to Use Data

We retain the right to use your questions to train AskGive.org.

Third Party Services

AskGive.org may include information from third party sources. Such sources are subject to their own terms and BBB Wise Giving Alliance is not responsible for the accuracy of the information provided by them.

Accuracy

AI and machine learning are always changing and evolving. We are constantly improving our services so that you enjoy the best of what we have to offer. Accuracy, safety, and reliability are among our core tenets. However, due to the nature of AI and machine learning, the use of AskGive.org may, in some situations, result in answers that are not 100% accurate.

By using AskGive.org, you understand and agree that answers may not always be accurate. You should not rely on answers from AskGive.org as a sole source of truth or factual information, or as a substitute for advice.

You are responsible for evaluating AskGive.org’s answers for accuracy and appropriateness for your use before using or sharing answers from AskGive.org.

You must not use any answers from AskGive.org relating to a person for any purpose that could have a legal or material impact on that person.

AskGive.org may provide incomplete, incorrect or offensive answers that do not represent the views of BBB Wise Giving Alliance. If answers reference any third-party products or services, it does not mean the third party endorses BBB Wise Giving Alliance, that BBB Wise Giving Alliance endorses the third party, or that BBB Wise Giving Alliance is affiliated with the third party.

Disclaimer of Warranties

OUR SERVICES ARE PROVIDED “AS IS.” EXCEPT TO THE EXTENT PROHIBITED BY LAW, WE MAKE NO WARRANTIES (EXPRESS, IMPLIED, STATUTORY OR OTHERWISE) WITH RESPECT TO ASKGIVE.ORG, AND DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, NON-INFRINGEMENT, AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING OUT OF ANY COURSE OF DEALING OR TRADE USAGE. WE DO NOT WARRANT THAT ASKGIVE.ORG WILL BE UNINTERRUPTED, 100% ACCURATE, OR ERROR FREE, OR THAT ANY CONTENT WILL BE SECURE OR NOT LOST OR ALTERED.

YOU ACCEPT AND AGREE THAT ANY ANSWERS FROM ASKGIVE.ORG ARE AT YOUR SOLE RISK AND YOU WILL NOT RELY ON THE ANSWERS AS A SOLE SOURCE OF TRUTH OR FACTUAL INFORMATION, OR AS A SUBSTITUTE FOR PROFESSIONAL ADVICE.

Limitation of Liability

BBB WISE GIVING ALLIANCE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA OR OTHER LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE LIMITATIONS IN THIS SECTION APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

Some countries and states do not allow the disclaimer of certain warranties or the limitation of certain damages, so some or all of the terms above may not apply to you, and you may have additional rights. In that case, these Terms limit our responsibilities to the maximum extent permissible in your country of residence.

Indemnity

If you are a business or organization, to the extent permitted by law, you will indemnify and hold BBB Wise Giving Alliance and its personnel harmless from and against any costs, losses, liabilities, and expenses (including attorneys’ fees) from any and all claims arising out of or relating to your use of AskGive.org or any violation of these Terms.

Dispute Resolution

In the event of any dispute arising from this Agreement, both parties agree to resolve such issues through binding arbitration, per the rules of the American Arbitration Association (AAA). AAA provides a method for dispute resolution outside of court proceedings.

General Terms

You may not assign or transfer any rights or obligations under these Terms.

We are continuously working to develop and improve AskGive.org. We may update these Terms or AskGive.org periodically. All changes will be effective on the date we post them to our website.

Our failure to enforce a provision of these Terms shall, in no way, be construed to be a waiver of that provision.

These terms contain the entire agreement between you and BBB Wise Giving Alliance regarding AskGive.org.

Virginia law will govern these Terms of Use. All claims arising out of or relating to these Terms shall be brought exclusively in the federal or state court of Virginia.
